General Terms and Conditions

Please read the following General Terms and Conditions (hereinafter referred to as "GTC") before using the registration / intermediary service. These form an integral part of the contract and apply in their current version.


1. Provider and Service

Vignettes Application Solution GmbH (hereinafter referred to as "Service Provider", "Intermediary" or "VAS") is a Swiss service and intermediary company with its registered office at Hornusserstrasse 1, 4600 Olten, Switzerland.

Through the online shop operated by VAS at www.swissvignette.ch, users are offered the possibility to request the registration of a vehicle in the official toll system of the respective country, in order to enable the use of toll or vignette-required roads.

VAS provides an independent administrative service. This service includes, in particular, the receipt, review and processing of the data submitted by the user, as well as the execution of the registration in the respective toll system on behalf of the user.

In connection with the acquisition of the vignette, VAS acts solely as an intermediary between the user and the official authority responsible for toll matters in the respective country. The purchase contract for the toll product is concluded exclusively between the user and the official authority and is facilitated by VAS.

For this service and intermediation, VAS charges a service or intermediation fee. The amount of this fee is transparently displayed to the user during the ordering process.

The license plate is registered in the official toll system, and the applicable toll fees are forwarded to the respective toll operator.

By completing the registration, the user acquires a digital vignette within the official system of the respective country and does not require a physical sticker.

VAS is not an official distributor or partner of the respective toll operators, but an independent service and intermediary provider.


2. Scope of Application

The version of these GTC valid at the time of use of the service shall apply. Previous versions shall not apply.

The services offered are intended exclusively for natural persons (consumers). Use by companies, legal entities or for commercial or self-employed professional purposes is excluded.

By completing the order process, the user expressly confirms that they are acting as a private individual and that they are using the service exclusively for personal purposes.

These GTC apply exclusively to the services offered, unless otherwise agreed in writing.


3. Conclusion of Contract and Performance of the Service

The presentation of the service in the online shop does not constitute a legally binding offer but an invitation to the user to submit an offer.

By completing the order process, the user submits a binding offer to conclude a contract for the provision of the registration service.

The contract is concluded upon receipt of the electronic order confirmation sent by VAS via email.

The subject of the service is the registration of the license plate provided by the user in the toll system of the respective country.

The service provider undertakes the careful execution of the registration on behalf of the user, including the review and processing of the submitted data.

The service may be supported by automated processes and supplemented by manual processing steps. The service provider reserves the right to review submitted data and, if necessary, request clarification or make corrections.

Processing is carried out within a short time but may vary due to external factors. Immediate or time-guaranteed registration is not owed.

The registration is only deemed completed once the electronic confirmation has been sent. Only from this point is the user entitled to use toll roads.

If the user uses toll roads before receiving confirmation and incurs penalties or charges, the service provider assumes no liability.

The user agrees that, within the scope of registration, the option “publicly accessible” may be selected to allow verification of the registration.


4. Withdrawal and Cancellation

Under Swiss law, there is no statutory right of withdrawal for the present service.

By completing the order process, the user expressly requests and authorizes the immediate execution of the service.

As the registration is initiated immediately after receipt of the order and reversal within the respective toll system is generally not possible, there is no entitlement to cancellation or refund after completion of the order.

This applies in particular in cases where incorrect information has been provided by the user or where the service cannot be used as intended for reasons beyond the control of the service provider.


5. Prices and Payment

All prices displayed in the online shop are gross prices in Swiss francs (CHF).

The total price consists of the fees charged by the respective toll operator and the service/intermediation fee charged by VAS.

The service fee is subject to Swiss VAT where applicable.

Payment is due immediately upon completion of the order process.

In the event of an unjustified chargeback (e.g. by initiating a dispute with the payment provider), the service provider reserves the right to claim the outstanding amount including any additional fees.


6. Obligations of the Contracting Parties

The user confirms that they are authorized to use the service.

The user is obliged to provide accurate and complete information, in particular regarding license plate and vehicle data. Incorrect information is the sole responsibility of the user.

The service provider is entitled to check the submitted data for plausibility.

To prevent input errors, the user may be required to confirm their data multiple times during the ordering process. There is no entitlement to automatic validation.

Corrections of incorrect data are only possible within the framework defined by the respective toll provider. Subsequent changes by VAS are generally excluded.


7. Final Provisions

The service provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Swiss law shall apply exclusively to the contractual relationship. The application of the Vienna Convention (CISG) and Swiss private international law is excluded.

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.

The applicable version of these GTC is the German version. Translations are provided for convenience only.

The exclusive place of jurisdiction is Olten, Switzerland.
